The Federal Food, Drug, and Cosmetic Act (FD&C Act) clearly defines and distinguishes drugs and cosmetics. Drugs are “products that cure, treat, mitigate or prevent disease or that affect the structure or function of the human body.” Drugs are carefully regulated by the FDA, which requires an intensive (and costly) inspection and review process before products are released for public consumption. Cosmetics are not.

Under the FD&C Act, “cosmeceutical” has no recognized or official definition. However, this class of products is understood to bestow benefits that go beyond the purely cosmetic—i.e., OTC products. Cosmeceuticals (claim to) deliver medicinal benefits that enhance the health and/or function of the skin.
